If the User disagrees with the handling of the complaint, or if immediate investigation of the complaint is not possible, the Service Provider shall immediately prepare a record of the complaint and its related position.

Preparation of a record

The record prepared regarding the complaint contains the User's name and address or electronic mailing address, the place, time, and method of submitting the complaint, a detailed description of the complaint, as well as a list of documents presented by the User. In the case of a verbal complaint made in person, the Service Provider provides a copy of the record to the User on site.

Telephone complaint handling

The Service Provider assigns a unique identification number to verbal complaints submitted by the User via telephone or other electronic communication services.

The Service Provider shall send a copy of the record prepared regarding the complaint to the User no later than simultaneously with the substantive response.

During telephone complaint handling, the Service Provider makes a voice recording, which is retained for five years.

The Service Provider provides the voice recording made during telephone administration free of charge at the User's request, furthermore ensures the possibility of listening to the voice recording at its customer service office, or sends a copy of it electronically upon request. The Service Provider fulfills the request for access to the voice recording within thirty days from becoming aware of the request.

2. Handling written complaints

Response deadline

The Service Provider shall respond to the User's written complaint in writing, substantively, and in a verifiable manner within thirty days of receipt. If the Service Provider rejects the User's complaint, it is obliged to provide reasons for its position.

If the User does not provide their name and address or electronic mailing address, fails to provide a detailed description of the complaint, or does not provide the documents, records, and other evidence necessary for assessing the complaint, the Service Provider is not obliged to respond to the complaint.

The Service Provider shall immediately confirm receipt of complaints submitted through the electronic interface/form provided by it at the electronic mailing address provided by the consumer upon receipt of the written complaint.

Retention of documentation

The Service Provider shall retain the record prepared regarding the complaint, the written complaint, and a copy of the substantive response provided for three years, and shall present them upon request by supervisory authorities.

3. Legal remedies

If the Service Provider rejects the complaint, it shall inform the User in writing about which authority or conciliation body they may initiate proceedings with regarding their complaint.  fogyasztovedelem.kormany. … /fogyasztovedelmi_hatosag

3.1. Initiation of conciliation board proceedings

During the handling of complaints and informing consumers, the Service Provider cooperates with associations representing consumer interests, as well as with consumer protection authorities.

The Service Provider informs the User that it has submitted a written, general declaration of submission valid until withdrawal to the conciliation body according to its registered office or – with effect extending to all conciliation bodies – to the MKIK.

The Service Provider informs Users that, in addition to Users qualifying as consumers, the following may also turn to a conciliation body: civil organizations acting for purposes outside their independent occupation and economic activity according to separate legislation, legal entities of churches, condominium associations, housing cooperatives, consumers who are citizens of a Member State or have their place of residence in a Member State, as well as businesses established in a Member State that purchase goods or use services exclusively for final use within the Union, or act with such an intention.

3.2. Consumer protection authority proceedings

Before initiating proceedings by the consumer protection authority, the User is obliged to attempt to resolve the disputed matter directly with the Service Provider.

The User may initiate consumer protection authority proceedings if the Service Provider has violated provisions contained in consumer protection legislation, especially its obligations related to distribution, provision of services, complaint handling, customer service, product quality, composition, packaging, pricing, handling warranty and guarantee claims, as well as consumer information obligations.

The application submitted to the consumer protection authority must contain:

  • the name and registered office address of the Service Provider,
  • the location where the objected conduct was committed,
  • a brief description of the subject matter of the application supported by available documents, including in particular the Service Provider's response letter provided in response to the User's inquiry, the record prepared regarding a verbal complaint, and, in the case of complaints submitted by post or electronically, the document proving submission.

Proceedings by the consumer protection authority may not be initiated more than three years after the violation occurred. If the unlawful conduct is continuous, the deadline begins when the conduct is discontinued.

In consumer protection authority proceedings – within the scope of protecting the consumer interests they represent – associations representing consumer interests also have the rights of a client.

If the consumer protection authority establishes a violation of consumer protection provisions, it may, among other things, order the termination of the unlawful situation, prohibit continuation of the unlawful conduct, require the Service Provider to eliminate identified deficiencies within a specified deadline, or impose a consumer protection fine.
